Terms and Conditions for the Reservation, Purchase and Use of Class Passes

This document sets out the rules for reserving a class pass, purchasing it at the premises, and using it at Bawialnia Kropka when online payment is unavailable.

These Terms apply only to class passes. Hour packs and the morning pass have separate terms.

These Terms are accepted electronically when making a reservation. Purchase and activation at the premises do not require signing a separate paper agreement, unless mandatory law requires otherwise.

1. Seller details

The seller of the passes is Oleksandra Tailer-Melyn, conducting business under the firm name Oleksandra Tailer-Melyn, entered in the Central Register and Information on Economic Activity (CEIDG), NIP: 6772533001, REGON: 543183649, under the Bawialnia Kropka brand.

2. Definitions

A Class Pass is a package covering a set number of classes stated in the selected pass description, with the validity period shown in the offer.

Class type, number of units, price, validity and additional conditions are shown on the selection and reservation page.

A Reservation means the Buyer’s declaration of intent to purchase the selected Class Pass and preferred visit date and time. A Reservation is not a purchase and creates no payment obligation.

Buyer — a natural person who made a Reservation or purchased a Pass and holds the account.

Pass User — a child or children added to the Buyer’s account who attend the classes.

3. Class pass reservation and acceptance of the Terms

When online payment is unavailable, the Buyer may reserve a Class Pass via the Bawialnia Kropka website.

Reservation requires signing in, selecting a Class Pass, providing contact details, choosing a preferred visit date and time, and accepting these Terms.

Acceptance is stored with date, time and document version.

A Reservation does not create a payment obligation or conclude the agreement.

4. Conclusion of the agreement, activation and validity

The agreement is concluded at the premises when the Buyer pays and the Seller accepts payment and activates the pass.

Purchase and activation do not require a separate paper agreement.

Validity runs from activation as stated in the package description until the end of the day shown on the Buyer’s account.

Unused classes expire after the validity period unless the package description states otherwise.

5. Rules of use

A Class Pass entitles the user to attend the classes stated in the description, for the number of units on the pass.

Each reception-confirmed use of a class unit reduces the remaining balance.

A Class Pass is not a playroom hour pack.

Specific class times may require prior confirmation at the premises.

The pass is tied to the Buyer’s account and may be used by children added to that account, subject to the class conditions.

6. Payment and purchase confirmation at the premises

Payment is made at Bawialnia Kropka during the agreed visit.

Until payment and activation, the pass is not considered purchased.

Failure to attend the agreed time may result in cancellation of the reservation.

7. Cancelling a reservation and withdrawal

The Buyer may cancel the reservation before the agreement is concluded by contacting the Seller.

A Reservation creates no payment obligation.

Because the agreement is concluded at the premises, the 14-day distance-selling withdrawal right generally does not apply.

8. Complaints

A complaint about a Class Pass may be submitted:

  1. by e-mail to bawialniakropka@gmail.com;
  2. in writing to the Seller’s address;
  3. in person at the premises.

  • in person at the venue.

The Seller responds to a consumer complaint within 14 days of receipt, unless mandatory law provides otherwise.

9. Personal data

Personal data are processed to handle the reservation, conclude and perform the agreement, keep pass records, and handle complaints.

Detailed information about the data controller, the legal grounds for processing, retention periods, data recipients, and users’ rights is provided in the Privacy Policy available on the Bawialnia Kropka website.

10. Final provisions

Polish law applies, without depriving the consumer of mandatory protection.

The version accepted at reservation applies to that reservation and agreement.

These Terms do not cover hour packs or the morning pass.
