Terms for Reservation, On-Premises Purchase and Use of the Morning Pass

1. A Morning Pass is valid for 30 consecutive calendar days. The day of activation is day 1 of the validity period. The pass remains valid through the end of the 30th calendar day inclusive. Exact start and end dates are shown on the Buyer’s account and in the purchase confirmation.

2. The price of the Morning Pass equals the per-child rate multiplied by the number of children named on the pass (covered children). Hours of use (hours of stay) and additional conditions are shown on the selection and reservation page and confirmed before payment on the premises.

3. The pass entitles holders to one shared visit per calendar day. All or only some of the covered children may take part in that visit; a separate entry on the same day is not available for a covered child who did not take part in that visit.

4. A Reservation means the Buyer’s declaration of intent to purchase the Morning Pass and preferred visit date and time. A Reservation is not a contract and creates no payment obligation.

5. Buyer — a natural person who made a Reservation or purchased a Pass and holds the account.

6. Pass User — a child or children named on the pass (covered children), using the playroom under these Terms and the general Bawialnia Kropka house rules.

7. Guardian — an adult who accompanies the child and is responsible for the child during the stay at the premises.

1. When online payment is unavailable, the Buyer may reserve a Morning Pass via the Bawialnia Kropka website.

2. Reservation requires signing in, selecting the Morning Pass, naming the covered children, providing contact details, choosing a preferred visit date and time, and confirming familiarisation with these Terms.

3. By confirming familiarisation with the Terms at reservation, the Buyer confirms knowledge of the conditions on which a contract may be concluded on the premises. The Terms become part of the contract only after confirmation of their acceptance as part of the contract and of the essential terms before payment, and after payment.

4. Confirmation of familiarisation is stored with date, time and document version. The version with which the Buyer became familiar at reservation is sent to the Buyer by email as a PDF or in another form that allows the content to be stored and reproduced unchanged.

5. A Reservation is not a contract and creates no payment obligation. The stated visit time is preferred only.

6. The Entrepreneur may contact the Buyer to confirm or propose a change to the visit time.

1. The agreement is concluded on the premises when the Buyer confirms the essential terms and makes payment. After the contract is concluded, the Entrepreneur activates the pass in accordance with the agreed activation date.

2. Before concluding the contract, the Buyer may review again these Terms and the general Bawialnia Kropka house rules (available on the website or on the premises). Before payment, the Buyer is informed of the final price, validity period, hours of use, covered children, known planned closure days or reduced opening hours falling within the validity period — if known to the Entrepreneur at purchase — and other essential terms. Payment confirms the essential terms, acceptance of the Terms as part of the contract, and conclusion of the contract.

3. Confirmation of acceptance of the Terms before payment is recorded together with the date, time and version of the Terms. The final price, covered children, validity dates and hours of use are stated in the purchase confirmation.

4. Purchase does not require a separate paper agreement.

5. The content of the contract is set by: these Terms in the version provided to the Buyer and confirmed by the Buyer immediately before payment, the description of the Morning Pass, the price, validity, hours of use and covered children confirmed at payment, and applicable law.

6. If the version of the Terms or other essential terms presented before payment differ from those presented at reservation, the Buyer is given the opportunity to review the changes and may withdraw from purchasing the pass without any cost.

7. After the contract is concluded, the pass is assigned to the Buyer’s account. Unless otherwise agreed, the pass is activated on the payment day. At the Buyer’s request and with the Entrepreneur’s consent, a later activation date may be set and stated in the purchase confirmation.

8. Validity is 30 consecutive calendar days. The activation day is day 1. The pass is valid through the end of the 30th calendar day inclusive. Start and end dates appear on the Buyer’s account and in the purchase confirmation.

9. The pass may be used during the hours of use on days when Bawialnia Kropka is actually open. Planned closure days or reduced opening hours known at purchase are communicated to the Buyer before payment.

10. Unused days are not transferred or exchanged for a cash equivalent unless expressly agreed with the Entrepreneur.

11. If, after purchase, the venue is completely unavailable for an entire day for reasons relating to the Entrepreneur’s operations, the validity period is extended by one day. In the event of a partial restriction of availability for such reasons, the Buyer is entitled to compensation; the form of compensation is determined in light of the scope of the actual restriction and agreed with the Buyer, in particular by an appropriate extension of validity, a discount, or another form agreed by the parties.

12. Non-use of the pass for reasons attributable to the Buyer, including a change of plans, absence or a voluntary decision not to visit, does not in itself entitle the Buyer to a refund of the price or an extension of validity. This does not limit the Buyer’s rights in case of non-performance or improper performance by the Entrepreneur or other rights under mandatory law.

13. During each visit the Buyer, the child and the Guardian must observe the general Bawialnia Kropka house rules.

1. The Morning Pass entitles the child to stay in the playroom only during the hours of use stated in the pass description (for example 10:00–15:00), on days when the venue is actually open.

2. Entry takes place after confirmation by reception. Confirmation opens an active visit for the covered children who actually take part in the visit. Time remaining until the end of the hours of use and — if the stay continues — time beyond those hours may be shown on the Buyer’s account and in the reception system.

3. The child should leave the playroom by the end of the hours of use. Stay after the hours of use end is not covered by the Morning Pass.

4. If the visit continues after the hours of use end, the Buyer must pay for the further stay. The surcharge is PLN 0.50 for each started minute of stay beyond the hours of use, charged separately for each child who actually remained in the playroom during the relevant time. Each started 60-second interval is rounded up to a full minute. For example, a stay of 1 to 60 seconds counts as one minute, and a stay of 61 to 120 seconds counts as two minutes.

5. For example, if two children remain in the playroom for 10 started minutes after the hours of use end, the surcharge is 10 × 2 × PLN 0.50 = PLN 10.00.

6. An individual child’s participation in the visit ends when that child actually leaves the playroom. The whole visit is considered ended when the last child taking part in the visit actually leaves the playroom and reception confirms the end of the visit. The Buyer or Guardian must notify reception of each child’s departure without undue delay. In the event of a technical error, a delay attributable to reception, or a discrepancy between system data and the actual departure time, the surcharge is determined according to each child’s actual length of stay.

7. The surcharge is settled when the visit ends on the premises. Information about the amount due, the date it arose and how it was calculated (including the number of minutes and children) is provided to the Buyer on the account or by reception. Until the amount due is settled, the Entrepreneur may refuse to start another visit or confirm another entry. With reception’s consent, settlement may be deferred to the next visit; the amount remains due until it is paid, an incorrect charge is corrected, or the Entrepreneur confirms in writing or electronically that it will not pursue the amount.

8. Within one calendar day, one shared visit may take place under the pass. All or only some of the covered children may take part in that visit.

9. Children taking part in a given visit enter within one shared visit accompanied by a responsible Guardian. Individual children may end their participation earlier; ending a child’s participation is final and does not entitle that child to re-enter on the same calendar day. The whole visit ends after the last participating child leaves. The surcharge for stay beyond the hours of use is charged separately only for children who actually remained in the playroom during the relevant time. After the visit ends, another child covered by the same pass may not use the pass for a separate entry on the same calendar day, unless the Entrepreneur separately agrees otherwise. The number of Guardians is determined by the general venue house rules and the current price list.

10. No minute- or hour-based deduction applies for stay during the hours of use — this is a period-based model (30-day validity), not an hour pack. The surcharge referred to in points 4–7 applies only to time beyond the hours of use and does not reduce the pass validity period.

11. The pass is tied to the Buyer’s account and may not be transferred to another buyer or used for children not named on the pass. The child may be accompanied by the Buyer or another adult Guardian authorised by the Buyer in accordance with the general Bawialnia Kropka house rules. Authorisation of a Guardian may be given via the Buyer’s account, by email, by a message to the Entrepreneur’s contact number, or in another manner sufficient to confirm the Buyer’s will. A written power of attorney is not usually required. The Entrepreneur may ask for additional confirmation of authorisation if there are reasonable doubts as to the Guardian’s identity, the scope of their authorisation or the child’s safety.

12. The pass may be used only by the children named on the pass (covered children). Entry with other children is not covered by this pass. The pass may not be transferred to another child. Changing a covered child after activation is possible only with the Entrepreneur’s prior consent.

13. The pass may not be exchanged for an hour pack, and its unused value is not paid out in cash, except as provided in these Terms or under mandatory law.

1. Payment is made at Bawialnia Kropka during the agreed visit.

2. Before payment, the Buyer is informed of the essential terms, including the pass type, final price, validity period, hours of use, covered children, the surcharge for stay beyond the hours of use (PLN 0.50 for each started minute for each child taking part in the visit), and — if known to the Entrepreneur — planned closure days or reduced opening hours during the validity period. Rules on reviewing the Terms and house rules again are set out in point 4.2.

3. After payment, the Buyer receives a purchase confirmation in paper or electronic form. The confirmation includes at least: the pass type, the per-child rate, the number and names of covered children, the total price, the activation date, the end date, the hours of use, and the version of the Terms that forms part of the contract.

4. After payment, information about the pass, activation and validity period is also available on the Buyer’s account.

5. Until payment, the pass is not considered purchased.

6. Failure to attend the agreed time may result in cancellation of the reservation.

1. The Buyer may cancel the reservation before the agreement is concluded by contacting the Entrepreneur.

2. A Reservation creates no payment obligation and does not constitute purchase of a pass or conclusion of a contract.

3. Because a Reservation is not a contract, and the contract for purchasing the Morning Pass is concluded on the premises of Bawialnia Kropka upon confirmation of the essential terms and payment, the 14-day distance-selling withdrawal right does not apply to that contract.

4. This does not limit the Buyer’s other rights under applicable law. If online payment is introduced or a distance contract is concluded, separate information duties and — to the extent required by law — a right of withdrawal will apply.

1. The person who concluded the contract, or their authorised representative, may submit a complaint about reservation, purchase, activation or use of the Morning Pass:

1. by e-mail to bawialniakropka@gmail.com;
2. in writing to the Entrepreneur’s address;
3. in person at the premises.

2. A complaint should preferably include: contact details, full name, reservation or pass number, a description of the problem, and the desired remedy.

3. The Entrepreneur replies to a complaint without undue delay, and no later than within 14 days of receipt. The consequences of failing to reply within the time limit are determined by applicable law.

4. The reply is sent to the e-mail address or by another method indicated by the person submitting the complaint.

1. The Buyer’s personal data are processed to handle the reservation, conclude and perform the agreement, keep pass records, and handle complaints.

2. The Entrepreneur also processes the names of covered children to identify persons entitled to use the pass, record visits and support safe stays — to the extent necessary for those purposes.

3. The Buyer confirms that they are entitled to provide the data of the children named on the pass and to arrange their visits to Bawialnia Kropka.

4. The system may store information about confirmation of familiarisation with or acceptance of the Terms (including document version), the reservation, the selected pass, covered children, preferred visit time and activation.

Detailed information about the data controller, the legal grounds for processing (including names of children covered by the pass), retention periods, data recipients, and users’ rights is provided in the Privacy Policy available on the Bawialnia Kropka website at: https://bawialniakropka.pl/en/polityka-prywatnosci.

1. Polish law applies, without depriving the consumer of mandatory protection.

2. The version of the Terms provided to the Buyer and confirmed by the Buyer immediately before payment applies to the contract. If that version differs from the version presented at reservation, point 4.6 applies.

3. These Terms do not cover hour packs or class passes.

4. In case of conflict between these Terms and the general venue house rules on price, validity, activation and use of the Morning Pass, these Terms prevail.

5. The current version is available on the Bawialnia Kropka website.

6. These Terms enter into force on the date stated at the beginning of the document.
