Pass Terms and Conditions

This document sets out the rules for online purchase, activation and use of passes for the Bawialnia Kropka playroom with online payment.

1. Seller details

The seller of passes is Oleksandra Tailer-Melyn, conducting business under the firm name Oleksandra Tailer-Melyn, entered in the Central Register and Information on Economic Activity (CEIDG), NIP: 6772533001, REGON: 543183649, under the Bawialnia Kropka brand.

2. Definitions and pass types

A Pass is a package of hours intended for use of the playroom, for example 10, 20 or 30 hours, with the validity period specified in the description of the relevant package. The available pass options, validity periods and prices are provided on the pass purchase page.

Buyer — a natural person who has concluded an agreement concerning the purchase and use of a Pass and is the holder of the account to which the Pass is assigned.

Pass User — a child or children added to the Buyer’s account who use the playroom in accordance with the rules of Bawialnia Kropka.

Additional terms specified in the package description before purchase may apply to a particular Pass.

3. Pass purchase and contract formation

A pass can be purchased online through the Bawialnia Kropka website when online payment is available.

To complete a purchase, the Buyer must log in to their account, select a pass, provide the required details, accept these Terms and Conditions, and complete online payment.

The agreement concerning the purchase and use of a Pass is formed once the Bawialnia Kropka system receives confirmation of successful payment completion from the payment operator.

Confirmation of contract formation, information about the purchased pass and the terms of the agreement are sent to the Buyer at the e-mail address provided.

4. Activation and validity period

After confirmation of successful payment, the Pass is assigned to the Buyer’s account and activated.

The validity period of the Pass is calculated from the moment of activation, that is from confirmation of successful payment.

The Pass remains valid until the end of the day shown in the Buyer’s account as the expiry date.

Any unused hours after the validity period ends become unavailable for use and are not transferred to another Pass, except as provided in these terms.

As long as unused hours remain on the Pass, the Buyer may extend validity at reception by a further 30 calendar days for PLN 10 — before expiry or within 7 calendar days starting from the day following the expiry date. After expiry and until an extension is arranged, the Pass is inactive; within those 7 days the ability to use the remaining time may be restored by an extension. If extended before expiry, 30 calendar days are added to the current expiry date; if after expiry — from the day the extension is paid for. Failure to extend within 7 days means the remaining time is finally cancelled. There is no limit on the number of extensions; the fee for each 30-calendar-day extension is PLN 10.

5. Usage rules

The minimum amount of time deducted from the Pass for a single visit is 30 minutes per child.

After the first 30 minutes, time is deducted by the minute.

For example, if two children stayed in the playroom for 20 minutes, a minimum of 60 minutes is deducted from the Pass — 30 minutes for each child.

No more than one visit may be started under a single Pass on any calendar day, regardless of the number of children included in the visit.

The Pass is assigned to the Buyer’s account and may not be transferred to another person without the consent of Bawialnia Kropka.

The Pass may be used by children added to the Buyer’s account.

If more than one child uses the Pass during a single visit, the time deducted from the Pass is multiplied by the number of children. A minimum charge of 30 minutes applies to each child.

At least 30 minutes per child taking part in the visit must remain on the Pass in order to start a new visit. If the remaining time is insufficient, a Pass visit is not started; the Buyer may extend the Pass or pay for the visit at the premises’ current standard tariff. The remaining time is not cancelled until validity ends (or an extension).

If all available time on the Pass is used during an ongoing visit, the Buyer is required to pay for any additional stay. The fee is PLN 0.50 for each minute beyond the Pass (separately for each child).

Unused hours cannot be exchanged for cash.

6. Online payments

Online payments are processed by Przelewy24.

After clicking “I buy and pay”, the Buyer is redirected to the operator’s secure payment page.

Available payment methods are shown directly on the Przelewy24 payment page.

Payment is considered completed once the Bawialnia Kropka system receives confirmation of its successful completion from the payment operator.

The Buyer’s return from the Przelewy24 page to the Bawialnia Kropka website does not in itself constitute confirmation of successful payment.

If payment is declined, cancelled or not completed, the Pass is not considered purchased and is not assigned to the Buyer’s account as active.

7. Right of withdrawal

A Buyer who is a consumer may withdraw from a distance contract within 14 days of its conclusion without giving a reason.

A withdrawal statement may be sent by e-mail to bawialniakropka@gmail.com or in writing to the Seller’s address.

To meet the deadline, it is sufficient to send the statement before the 14-day period expires.

If withdrawal is effective, the Seller refunds payments received from the Buyer in accordance with applicable law. The refund is made using the same payment method used by the Buyer, unless the Buyer has expressly agreed to a different refund method.

If, at the Buyer’s express request, use of the Pass began before the withdrawal period expired, upon withdrawal the Buyer must pay for the portion of the service actually provided until the withdrawal notice was submitted.

The amount due for the portion of the service provided is determined in proportion to the extent of the service used.

The Buyer may lose the right of withdrawal after the service has been fully performed if, before performance began, they gave explicit consent to its commencement and were informed that they would lose the right of withdrawal after the service was fully performed.

8. Complaints

A complaint regarding a pass may be submitted:

  • by e-mail to bawialniakropka@gmail.com;
  • in writing to the Seller’s address;
  • in person at the venue.

The complaint should preferably include the Buyer’s full name, the order number or pass number, a description of the issue, and the preferred way of resolving it.

The Seller will respond to a consumer complaint within 14 days of receiving it, unless mandatory provisions of law provide for a different time limit.

The response will be sent to the Buyer’s e-mail address or by another method indicated by the Buyer.

Phone contact may be used to obtain information about the complaint submission procedure.

9. Personal data

The Buyer’s personal data is processed for the purposes of concluding and performing the agreement, handling online payments (including transferring data necessary to process payment to the payment operator Przelewy24), maintaining pass records, handling complaints, and fulfilling the Seller’s legal obligations.

Detailed information about the data controller, the legal grounds for processing, retention periods, data recipients, and users’ rights is provided in the Privacy Policy available on the Bawialnia Kropka website.

10. Final provisions

Polish law applies to agreements concluded under these Terms and Conditions. This provision does not deprive consumers of the protection granted by mandatory provisions of law.

In matters not regulated by these Terms and Conditions, the provisions of Polish law apply, including in particular the Polish Civil Code and the Polish Consumer Rights Act.

The version of the Terms and Conditions accepted by the Buyer when the agreement was formed applies to the relevant Pass, unless mandatory provisions of law provide otherwise.

Changes to these Terms and Conditions do not affect rights acquired by the Buyer before such changes enter into force.

The current version of these Terms and Conditions is available on the Bawialnia Kropka website.

These Terms and Conditions enter into force on the date stated at the beginning of the document.
